These Pre-Order Terms apply in addition to the General Terms and Conditions of mvdham GmbH (“mvdham”) to products expressly offered or agreed as pre-orders.
In the event of a conflict between these Pre-Order Terms and the General Terms and Conditions in relation to a pre-order, these Pre-Order Terms shall prevail to the extent of that conflict.
1. What Is a Pre-Order?
1.1 Certain mvdham products may be offered for purchase before they are available for regular delivery. Such orders are referred to as “Pre-Orders”.
1.2 By placing a Pre-Order, the Customer orders a product that is expected to be produced, completed or become available for delivery at a later date.
1.3 A standard Pre-Order relates to the product in the version described and shown on the relevant product page, subject to the product information and any options selected by the Customer.
1.4 The fact that a product is offered as a Pre-Order does not by itself mean that the product is custom-made or personalised.
2. Payment
2.1 The full purchase price for a Pre-Order is due at the time the order is placed, unless expressly agreed otherwise.
2.2 The available payment methods are displayed during checkout.
2.3 Payment in advance does not affect the Customer’s mandatory statutory rights.
3. Expected Delivery Time
3.1 Unless a different delivery period is expressly stated on the relevant product page or agreed with the Customer, the expected delivery time for Pre-Order products is approximately 8–12 weeks from the date of the order.
3.2 The applicable expected delivery period will be communicated to the Customer before the order is placed.
3.3 Pre-Order products are produced or made available according to production and delivery schedules. If circumstances arise that are expected to materially affect the communicated delivery period, mvdham will inform the Customer without undue delay.
3.4 Any mandatory statutory rights of the Customer in the event of delayed delivery remain unaffected.
4. Standard Pre-Orders and Customised Pre-Orders
4.1 mvdham distinguishes between standard Pre-Orders and individually customised or personalised orders.
Standard Pre-Orders
4.2 A standard Pre-Order is an order for a product substantially as described and shown on the relevant product page, without individual modifications that make the product specifically tailored to the Customer’s personal requirements.
4.3 A standard Pre-Order is not considered custom-made merely because the product is produced or made available after the Customer places the order.
Customised and Personalised Pre-Orders
4.4 mvdham may also accept Pre-Orders for products that are individually produced, altered or personalised according to specifications selected by or individually agreed with the Customer.
4.5 Such customisation may include individual alterations or other specifications agreed between mvdham and the Customer.
4.6 Customised or personalised orders may also be agreed individually with mvdham, including in person or through individual communication such as email.
5. Right of Withdrawal – Standard Pre-Orders
5.1 Consumers retain their statutory right of withdrawal in relation to standard Pre-Orders where such a right exists under applicable law.
5.2 The fact that a product is a Pre-Order, is produced after the order is placed or has an expected delivery time of several weeks does not by itself exclude the statutory right of withdrawal.
5.3 The applicable withdrawal instructions, withdrawal period, procedure and consequences of withdrawal are set out in mvdham’s General Terms and Conditions and Withdrawal Instructions.
5.4 Where applicable, the statutory withdrawal period for goods generally begins upon receipt of the goods rather than on the date on which the Pre-Order was placed.
6. Custom-Made and Personalised Products
6.1 The statutory right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are made on the basis of an individual choice or decision by the Consumer, or to goods that are clearly tailored to the Consumer’s personal needs, where the statutory requirements for this exclusion are met.
6.2 This may apply, in particular, to jackets or other products that are individually produced, altered or personalised for the Customer based on specifications selected by or individually agreed with the Customer.
6.3 The mere designation of a product as “custom”, “custom-made”, “personalised” or “Pre-Order” does not by itself exclude the statutory right of withdrawal.
6.4 Where the statutory exclusion applies to a customised or personalised order, the Customer will be informed accordingly.
6.5 The exclusion of the statutory right of withdrawal does not affect the Customer’s statutory rights in the event that the product is defective or does not conform to the specifications agreed with the Customer.
7. Changes to a Pre-Order
7.1 Once a Pre-Order has been placed, requested changes to the product, including size, specifications or other product options, are subject to mvdham’s agreement.
7.2 mvdham cannot guarantee that changes can be made once production or processing of the Pre-Order has begun.
7.3 Where a requested change results in an individually customised or personalised product, mvdham will inform the Customer of the relevant conditions, including any consequences for the statutory right of withdrawal, where applicable.
7.4 Any additional price resulting from a Customer-requested modification will be communicated and agreed with the Customer before the modification is carried out.
8. Production and Product Characteristics
8.1 mvdham makes reasonable efforts to ensure that Pre-Order products correspond to the product description and images provided at the time of the order.
8.2 Colours displayed on screens may vary slightly from the actual product due to screen settings, photography, lighting and other technical factors.
8.3 Minor variations that are customary for the materials used or result from craftsmanship or production processes do not constitute a defect, provided they are reasonable and do not materially affect the agreed characteristics of the product.
8.4 For customised products, the specifications individually agreed with the Customer form part of the agreed characteristics of the product.
9. Delays
9.1 The expected delivery period for a Pre-Order is stated in Section 3 or, where different, on the relevant product page or in the individual agreement with the Customer.
9.2 If mvdham becomes aware of a material delay, mvdham will inform the Customer without undue delay and, where possible, provide an updated expected delivery period.
9.3 A production or delivery delay does not limit any mandatory statutory rights available to the Customer.
10. Unavailability
10.1 In exceptional circumstances, a Pre-Order product may become unavailable, for example because production cannot be completed or required materials are no longer available.
10.2 If performance becomes impossible and mvdham is no longer obliged to deliver the product under applicable law, mvdham will inform the Customer without undue delay.
10.3 Any payment received for a product that cannot be supplied will be reimbursed in accordance with applicable law.
11. Returns
11.1 For standard Pre-Orders for which a statutory right of withdrawal exists, the withdrawal and return provisions contained in mvdham’s General Terms and Conditions apply.
11.2 Where the Customer exercises a statutory right of withdrawal, the Customer bears the direct costs of returning the goods as stated in mvdham’s Withdrawal Instructions.
11.3 Products that meet the statutory requirements for the exclusion applicable to custom-made or personalised goods are not subject to the statutory right of withdrawal.
11.4 Nothing in these Pre-Order Terms limits the Customer’s statutory rights in respect of defective goods or goods that do not conform to the agreed specifications.
12. General Terms and Conditions
12.1 mvdham’s General Terms and Conditions apply in addition to these Pre-Order Terms.
12.2 In particular, the provisions of the General Terms and Conditions concerning conclusion of the contract, payment, statutory rights in the event of defects, liability, applicable law and jurisdiction continue to apply unless expressly modified by these Pre-Order Terms.
12.3 Mandatory statutory Consumer rights remain unaffected.
